Terms of Service

Effective date: March 30, 2026

Welcome to SANAOL (the "App"), operated by TechniqalGroup MCS ("Company," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you and the Company governing your access to and use of the App. By downloading, accessing, creating an account, or otherwise using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the App. If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By creating an account, you represent and warrant that you meet these eligibility requirements and that all registration information you provide is truthful and accurate.

2. Account Registration and Security

• You must provide accurate, current, and complete information during registration and keep your account information up to date.
• You may register using your email address and password, or through a supported third-party authentication provider (Google, Facebook, or Apple).
• You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us immediately at techniqalgroup@gmail.com if you suspect any unauthorized use of your account.
• We reserve the right to suspend or disable accounts that we reasonably believe have been compromised.

3. Acceptable Use

When using the App, you agree not to:

• Use the App for any purpose that is unlawful or prohibited by these Terms.
• Harass, bully, threaten, stalk, intimidate, or abuse any other user, including through misuse of the App's location, messaging, or calling features.
• Post, transmit, or share content that is defamatory, obscene, pornographic, hateful, discriminatory, or that promotes violence.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Share another person's personal information, including their location, without their explicit consent.
• Use the real-time location or map features to track, monitor, or surveil any individual without their knowledge and consent.
• Upload, transmit, or distribute viruses, malware, spyware, or any other harmful or malicious code.
• Attempt to gain unauthorized access to the App, its servers, databases, or any other user's account.
• Use automated means — including bots, scrapers, crawlers, or scripts — to access the App, collect data, or interact with the App's features.
• Interfere with, disrupt, or place an unreasonable load on the App's infrastructure, servers, or networks.
• Circumvent, disable, or otherwise interfere with any security, privacy, or access-control features of the App.
• Use the App for commercial solicitation, advertising, or spam without our prior written consent.
• Record, capture, or redistribute voice or video calls made through the App without the consent of all participants.

4. User-Generated Content

4.1 Ownership

You retain all ownership rights in the content you create and share through the App ("User Content"), including posts, comments, photos, videos, stories, and messages.

4.2 License Grant

By posting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify (e.g., resize, compress, transcode, generate thumbnails), distribute, display, and perform your User Content solely for the purpose of operating, providing, improving, and promoting the App. This license continues until your User Content is deleted from our systems.

4.3 Responsibility

You are solely responsible for the User Content you post. You represent and warrant that: (a) you own or have the necessary rights to post your User Content; (b) your User Content does not infringe or violate any third party's intellectual property rights, privacy rights, or other rights; and (c) your User Content complies with these Terms and all applicable laws.

4.4 Content Moderation

We do not endorse any User Content and are not obligated to monitor, review, or screen content. However, we reserve the right to remove, disable, or restrict access to any User Content that violates these Terms or that we deem inappropriate, harmful, or objectionable, at our sole discretion and without prior notice.

5. Location-Based Features

The App includes location-based features that allow you to share your real-time position on an interactive map, discover nearby users, and tag posts with geographic locations. By enabling location services, you acknowledge and agree that:

• Sharing your location is voluntary and controlled by your privacy settings and device permissions.
• Your location may be visible to other users according to the privacy level you select (everyone, followers, mutuals, or no one).
• You should exercise caution when sharing your location, particularly with users you do not know personally.
• We are not responsible for any consequences arising from your decision to share or disclose your location.
• You can stop sharing your location at any time by adjusting your in-app privacy settings or revoking location permissions in your device settings.

6. Voice and Video Calls

The App provides voice and video calling functionality using peer-to-peer WebRTC technology. By using these features, you acknowledge that:

• Calls are established directly between participants; we do not record, store, or monitor call audio or video content.
• When a direct connection cannot be established, call media may be relayed through our TURN servers. Relayed data is not stored.
• Call metadata (participants, timestamps, duration, and call status) is logged for the purpose of operating the service and investigating abuse.
• You are responsible for obtaining consent from all participants before recording any call through external means.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, share, retain, and protect your information. By using the App, you consent to the practices described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

8. Intellectual Property

The App — including its design, user interface, logos, source code, graphics, audio assets, and all related materials — is the exclusive property of TechniqalGroup MCS and is protected by copyright, trademark, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or create derivative works based on the App or any part thereof without our express written permission.

The SANAOL name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TechniqalGroup MCS. You may not use such marks without our prior written permission.

9. Termination

• By you: you may delete your account at any time through the App's settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
• By us: we may suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or the App, or is otherwise inappropriate.
• Effect of termination: upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination shall remain in full force and effect, including but not limited to Sections 4.2 (License Grant), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law).

10. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT.

We do not warrant that: (a) the App will be uninterrupted, timely, secure, or error-free; (b) the results obtained from the App will be accurate or reliable; (c) the quality of any content, features, or services will meet your expectations; or (d) any errors will be corrected. We do not endorse, guarantee, or assume responsibility for any User Content, and we are not responsible for the accuracy of location data, user-provided information, or third-party content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TECHNIQALGROUP MCS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (C) ANY USER CONTENT; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA; OR (E) ANY OTHER MATTER RELATING TO THE APP.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF: (I) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (II) ONE HUNDRED PHILIPPINE PESOS (PHP 100.00).

12. Indemnification

You agree to indemnify, defend, and hold harmless TechniqalGroup MCS, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of another person or entity; or (e) any dispute between you and another user.

13. Modifications to the Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will post the revised Terms within the App and update the "Effective date" at the top of this page. Your continued use of the App after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree with the modified Terms, you must stop using the App and delete your account.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved exclusively in the competent courts located in the Philippines. You irrevocably consent to the jurisdiction and venue of such courts.

15. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be severed and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms or policies referenced herein, constitute the entire agreement between you and the Company regarding your use of the App and supersede all prior and contemporaneous agreements, understandings, and representations.

17. Waiver

The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by the Company.
